Q: How can I have my probation/supervised release terminated early?
Answer

You may be eligible for termination from probation or supervised release based on your performance on supervision, as well as other factors, to include a demonstrated  ability to lawfully self-manage beyond your period of supervision. Persons under supervision should make requests for early termination to their probation officer.

Q: I have a family member/friend who is scheduled to be released from prison. They were convicted in federal court in another district or state but want to reside in the District of Arizona. How can his/her case be transferred?
Answer

The person under supervision must request transfer of supervision through his/her Bureau of Prisons Case Manager. When the request is made by the case manager, the U.S. Probation Office will conduct an investigation to determine whether the individual may transfer and report its findings to the Bureau of Prisons. The transfer of jurisdiction may only occur with approval from the district that would receive and supervise the person under supervision.

Q: If I am convicted of a Federal crime, can I or a family member own or possess a firearm?
Answer

An individual convicted of a felony offense is legally prohibited from possessing a firearm under 18 U.S.C. § 922(g)(1). Possession of a firearm by a family member living in the same residence as a convicted felon could constitute constructive possession, which may violate federal law.

P: ¿Cómo puedo lograr que se termine el período de libertad preparatoria [en inglés Probation] o libertad supervisada [en inglés Supervised Release] antes de la fecha fijada?
Respuesta

Usted puede ser elegible para la terminación de la libertad condicional o la libertad supervisada según su desempeño en la supervisión, así como otros factores, para incluir una capacidad demostrada para autogestionarse legalmente más allá de su período de supervisión. Las personas bajo supervisión deben presentar solicitudes de terminación anticipada a su oficial de libertad condicional.

P: Tengo un pariente o amigo que está por salir de la prisión quien fue sentenciado en otro distrito o estado pero ahora quiere residir en el distrito de Arizona. ¿Cómo se puede trasladar su caso?

Él debe de solicitar el traslado de la supervisión por medio del administrador de su caso a la agencia de prisiones, en inglés se llama Bureau of Prisons Case Manager. Cuando el administrador del caso hace la solicitud, el departamento de libertad supervisada (en inglés Probation office) llevará a cabo una investigación para determinar si el caso del infractor puede ser trasladado y este reportara sus determinaciones a la agencia de prisiones.  El traslado de la jurisdicción se llevara a cabo solamente al ser aprobado por el distrito que recibiría y supervisaría al infractor.

P: ¿Si se me condena por un delito federal, puedo yo, o no de mis parientes tener, poseer o ser dueño de armas de fuego?

De acuerdo a la ley, una persona que fue encontrada culpable de un delito mayor tiene prohibido tener armas de fuego conforme a 18 U.S.C. 922(g)(1). Si algún pariente o cualquier persona que resida en la misma residencia con el sentenciado tienen armas de fuego, esto podría constituir posesión presuntiva del arma, lo cual podría ser una violación de las leyes federales.
